In addition to the local (national) works councils, international companies may also have a European Works Council. The manner in which the company (multinational) and the European Works Council interact with each other is determined particularly by an European Works Council which has to be agreed. This Agreement is based on the EU Directive on the establishment of an European Works Council (in The Netherlands implemented as the European Works Councils Act).
Influence of European Works Councils on Local Works Councils
If the company does not comply with its (European) co-determination obligations, the European Works Council has fewer means of exercising power at its disposal than a local works council. However the influence of the European Works Council on the local works councils plays an important role in communication with the company.
Special Role and Powers
Pallas Attorneys-at-Law advise both companies and European Works Councils on the special role and powers of the European Works Council. In this respect, we focus not only on the communication strategy, but also on divergences in the legal systems and cultures of different European countries.
