Where staff members are working for a company without an employment contract, such work is usually carried out under a management contract.
Risks
The Dutch tax authorities have clarified the legal position of self-employed individuals and the interpretation of management contracts. The Declaration of Employment Status (VAR) is an important document, since it creates a situation whereby a company is not obliged to deduct taxes and contributions from the service provider’s earnings. Nonetheless, management contracts do still have their risks in terms of employment, tax and social security law.
